J&K High Court sets aside adhoc committee; ‘conduct JKFA elections without delay’

Srinagar, May 30: The High Court of J&K and Ladakh on Monday set aside the setting of adhoc committee for the conduct of J&K Football Association (JKFA) elections and directed concerned to hold elections without delay.

The Court of Justice Vinod Chatterji Koul passed the directions on the petition filed by JKFA through its counsel Mian Abdul Qayoom vs J&K Sports Council & others who were represented by Sajad Ashraf, Senior Advocate ZA Shah and Javaid Ahmed.

The directions were issued on JKFA challenging the order passed by Additional District Judge Srinagar (Trial Court) on May 18-2022 in which Sports Council was given permission to constitute adhoc committee that will help in the conduct of JKFA elections.

After hearing both the parties , the High Court on Monday set aside the forming of adhoc committee and said that Trial Court had travelled beyond the scope of its own judgement.
“Verily the trial Court has travelled beyond the scope of its own judgement/order as also the application for extension of time. Having said that, this petition requires to be allowed partly and impugned order to the extent of appointing adhoc committee is liable to be set aside,” order reads.

“For the reasons discussed above. the instant petition is Partly allowed. Impugned order dated 18th May 2022 ,passed by 4th additional District Judge, Srinagar, to the extent directs the Sports Council to constitute adhoc committee to provide necessary assistance to J&K Sports Council to facilitate the conduct of elections, is set aside.Let the elections be held and concluded without any delay,” order reads.

“Disposed of in terms of above,” order added.

Meanwhile as per election notification issued by election commissioner appointed by Sports Council, the elections of JKFA are scheduled to be held on June 12 at Sheri Kashmir Indoor Stadium Srinagar.

Earlier Court of 4th Additional District Judge, Srinagar on May 18, had allowed Sports Council four weeks extension for the conduct of elections.
“It is further provided that in the face of the tenure of present office-bearers having come to an end on 12th of May 2022, therefore Sports Council would take steps, to constitute Adhoc Committee which would provide necessary assistance to J&K Sports Council to facilitate the conduct of elections. The application is accordingly disposed off and consigned to records,” the order stated.

JKFA had challenged the order and forming of adhoc committee, in which High Court today granted relief to Football Association as adhoc committee has been set aside.
