Srinagar: The Srinagar District Court has issued temporary stay order on conduct of ongoing Kashmir Cup 2025 cricket tournament being held at TRC Ground Srinagar.
The court of City Judge Srinagar, Abdul Bari on Tuesday issued stay order against the tournament on the plea of complainant filed by Mohammad Arif Mir, Owner and Captain of the Cricket Team “Valley Fresh Cold Chain” against the defendant Imran Bhat Organiser of ”Kashmir Cup 3″ Cricket Tournament.
“At this stage applicant has been able to carve out the prima facie case in his favour. Furthermore the balance of convenience also lies in his favour and he will suffer irreparable loss if relief is not granted. Issue notice to other side for filling of objections and in the meanwhile the defendant/non-applicant shall not proceed ahead with the tournament from the date of this order, till next date of hearing as fixed in the matter. However, non-applicant/defendant is at liberty to approach this court for vacation, modification, cancellation or clarification of order even before the next date of hearing. Learned counsel for the applicant is directed to supply all relevant material relied upon by him and file service affidavit as envisaged under law. Put up for further proceedings on 01-08-2025,” Court order while issuing stay order on the tournament said.
The complainant had approached court after the organizers as per him had allowed outside J&K players in the tournament which was against the rules drafted for the event.
“It is averred in the suit that the plaintiff is the owner and captain of “Valley Flesh Cold Chain”, a reputed and professional cricket team which has been actively participating in various cricket tournaments across the Valley for several years and has earned respect and recognition among cricket enthusiasts and the sports community. The defendant is the organiser of a tournament titled “Kashmir Cup 3”, which is advertised as a regional cricket tournament meant strictly for valley-based players. The defendant circulated promotional material and rules that were binding on all teams wishing to participate in the tournament. The plaintiff, after going through the terms, norms, and eligibility conditions laid down by the defendant, applied for participation in the said tournament and paid the requisite entry fees and other dues. As per the rules framed and advertised by the defendant himself, the participation was limited to local teams and players residing in Kashmir Valley, particularly from the districts of Srinagar, Budgam, Ganderbal, Kupwara, Bandipora, Kulgam, Anantnag, and Shopian,” order reads.
“Furthermore, participation of any overseas or outside-the-valley players was strictly barred and considered a disqualification. Despite these express conditions, the defendant, for his own personal gain and to unjustly enrich himself, unlawfully allowed overseas and out-of-valley players to participate, thereby not only breaching his own rules but also compromising the fairness and integrity of the tournament. On 21/07/2025, the plaintiff’s team was scheduled to play a match against the team Elegant Strikers. While the plaintiff and his players were warming up on the ground and discussing their game plan before the commencement of the match, they came to know from reliable sources and direct
observations that the organiser (defendant) had illegally permitted the participation of overseas and out-of-valley players in the tournament, in clear violation of the rules and eligibility conditions laid down by the defendant himself. Keeping in view the emergency projected in the suit and application for dispensation of notice, prior of notice as envisaged under law is dispensed with,” it reads.
“It is averred in the application that applicant/plaintiff has a prima facie case and balance of convenience lies in his favour. Further it is averred that the applicant would suffer an irreparable loss if relief is not granted,” it said.
The next hearing of the case is on August 1, but the defendants have allowed to approach Court before the said date.
